The StartMail Service is\ndesigned to maximize your privacy and keep you in control of your personal\ndata. We at StartMail care about your rights. We assume that you do\ntoo. Therefore, please take a moment to read our Terms of Service carefully. We\nhave done our utmost to make them as easy to read as possible and to provide you\nwith all the information you need.\u003C/p>\n\n\u003Cp>The StartMail Service is offered by StartMail B.V. ("StartMail"), a company\nestablished under Dutch law with its registered office in the city of Zeist at\nBoulevard 11, postal code 3707 BK, The Netherlands.\u003C/p>\n\n\u003Cp>These Terms of Service apply at all times during the use of the StartMail\nService.\u003C/p>\n\n\u003Ch2>Definitions (1)\u003C/h2>\n\n\u003Cp>At the end of this document you will find the definitions of the words in this\nagreement that begin with a capital letter.\u003C/p>\n\n\u003Ch2>Our Agreement\u003C/h2>\n\n\u003Cp>In order to create your Account you will be asked to accept these Terms of\nService and our Privacy Policy. Your acceptance is required to conclude an\nAgreement with us to become a User of the StartMail Service. In addition,\nmerely using the StartMail Service shall also constitute your consent to these\nTerms of Service and our Privacy Policy.\u003C/p>\n\n\u003Cp>Therefore, these Terms of Service at all times govern the use of the StartMail\nService and form an integral part of the Agreement between StartMail and each\nUser.\u003C/p>\n\n\u003Cp>We advise you to save a copy of these Terms of Service locally or print them.\u003C/p>\n\n\u003Cp>Any terms and conditions or exceptions put forward by you will not form part of\nthe Agreement, unless we have explicitly accepted them in writing.\u003C/p>\n\n\u003Ch2>Signing up for your StartMail Account\u003C/h2>\n\n\u003Cp>During the sign-up process you will be asked to register an e-mail address,\ne.g. \u003Ca href=\"mailto:user@startmail.com\">user@startmail.com\u003C/a>, and a password for your Account. If the e-mail address\nyou have chosen is not available, you must choose another e-mail address, which\nis available. Your password must meet the safety requirements as indicated in\nthe sign-up process.\u003C/p>\n\n\u003Cp>The name which you provide for your Account does not necessarily have to be your\nreal name, but you explicitly accept all responsibility and full liability for\nany damages, claims or other consequences that may arise as a result of signing\nup under a fictitious or pseudonymous name.\u003C/p>\n\n\u003Cp>In order to complete the sign-up process you must complete all mandatory fields\non the form. Once your order has been successfully submitted, you will be given\naccess to your Account when you log in with the e-mail address and password you\nhave chosen.\u003C/p>\n\n\u003Cp>During the sign-up process you may be informed of certain promotional offers,\nsuch as the possibility to try StartMail for free for a certain period. All\napplicable details and terms and conditions relating specifically to such\npromotional offers will be provided to you during the sign-up process when such\na promotional offer applies.\u003C/p>\n\n\u003Cp>After signing up, you may change your password at any time by using the\navailable option in your Account Settings. You can only access the Settings\nfeature while you are logged into your Account.\u003C/p>\n\n\u003Ch2>Confirmation and communication about your StartMail Account\u003C/h2>\n\n\u003Cp>Once you have successfully signed up, we will send an automatic welcome message\nto the inbox of your new StartMail Account, confirming that you have become an\nauthorized User of the StartMail Service, pursuant to the Agreement concluded\nbetween you, the User, and us, StartMail.\u003C/p>\n\n\u003Cp>Whenever we have an important message for you concerning your Account, for\nexample a reminder about payment in order to avoid the expiration of your\nAccount, we will send a message to your StartMail inbox. We may also suggest you\nto set a recovery e-mail address or provide you a recovery code to be able to\nhelp you recover your Account if you ever lose your password.\u003C/p>\n\n\u003Cp>We may also provide additional information services, but only after you have\nopted-in for them. You may opt out whenever you like by clicking the unsubscribe\nhyperlink in the message, or sending an email to \u003Ca href=\"mailto:support@startmail.com\">support@startmail.com\u003C/a> with the\nsubject of "Unsubscribe" and a note of the email address that you wish to remove\nfrom the list.\u003C/p>\n\n\u003Ch2>Duration\u003C/h2>\n\n\u003Cp>Unless otherwise stated in the Agreement, the Agreement is valid for an\nindefinite period. For the terms and conditions for termination, please review\nthe relevant sections below.\u003C/p>\n\n\u003Ch2>Cooling off period\u003C/h2>\n\n\u003Cp>Within the sign-up process, by agreeing to these Terms of Service you also agree\nto receive the StartMail Service right after signing up, and therefore no\ncooling off period shall apply. The cooling off period is a legal right for\nconsumers in Europe, to cancel an agreement concluded online, if certain\ncriteria are met. If the consumer agrees to receive the service immediately, no\ncooling off period will apply.\u003C/p>\n\n\u003Ch2>Authorized access\u003C/h2>\n\n\u003Cp>The StartMail Service may only be used by authorized Users, who provide Login\nDetails. You agree and understand that you are responsible for maintaining the\nconfidentiality of your Login Details, and that it is your responsibility to\nremember them.\u003C/p>\n\n\u003Cp>StartMail uses secure hashing methods in accordance with industry best\npractices, in order to store key material safely. StartMail supplies additional\ndetails about its hashing methods and other security measures in its security\nwhite papers. In order to keep up with technological developments, StartMail may\ndecide at any moment to update its security practices and white papers.\u003C/p>\n\n\u003Cp>StartMail may assume that someone logging onto the StartMail Service using the\nLogin Details actually is the User. After access has been obtained to the\nStartMail Service through the User's Login Details, the User bears the full\nresponsibility and risk for all subsequent activities undertaken in the\nStartMail Service (including the Account).\u003C/p>\n\n\u003Cp>In the event of any known or suspected misuse or compromise of the Login\nDetails, the User must notify StartMail immediately at \u003Ca href=\"mailto:abuse@startmail.com\">abuse@startmail.com\u003C/a> so\nthat the latter can take action.\u003C/p>\n\n\u003Cp>If StartMail becomes aware that the User's Login Details have been divulged to\nunauthorized third parties, StartMail will try to notify the User and take\nsuitable action.\u003C/p>\n\n\u003Cp>If you have provided us with a Recovery E-mail Address or opted to receive a\nRecovery Code, you have the ability to set a new password in the event you have\nlost your current password and are unable to log into the StartMail Service.\u003C/p>\n\n\u003Cp>WARNING: IF YOU FORGET YOUR PASSWORD AND HAVE NOT SUPPLIED US WITH A RECOVERY\nE-MAIL ADDRESS AND HAVE NOT OPTED TO RECEIVE A RECOVERY CODE, THERE IS NO WAY WE\nCAN ENABLE YOU TO REGAIN ACCESS TO YOUR ACCOUNT. THIS IS AN INTENTIONAL SECURITY\nFEATURE AND NOT A BUG. StartMail CANNOT BE HELD LIABLE FOR ANY DAMAGES OR LOSSES\nARISING OUT OF YOUR LOSS OF OR FAILURE TO REMEMBER YOUR PASSWORD.\u003C/p>\n\n\u003Cp>Please read our security white papers for more information about our security\nmeasures.\u003C/p>\n\n\u003Ch2>Terms of use\u003C/h2>\n\n\u003Cp>We have designed the StartMail Service around the principle that your e-mail is\nyour business and nobody else's, including ours. The privacy that we provide to\nyou through the StartMail Service does not place you above the law, and it must\nnot be abused. You are prohibited from using the StartMail Service to break the\nlaw or violate anyone's legal rights.\u003C/p>\n\n\u003Cp>Activities that are absolutely not tolerated by StartMail include the sending of\nSpam, the purchase or sale of stolen goods, making threats to person or\nproperty, possession or distribution of child pornography, and fraud.\u003C/p>\n\n\u003Cp>StartMail may immediately terminate the Agreement and delete the Account in the\nevent of a violation of the Terms of Use, and retain any evidence or information\nrelevant to this decision. In the event of such termination, StartMail will\nnotify the User by means of the Recovery E-mail Address, if one was previously\nset.\u003C/p>\n\n\u003Ch2>Measures against Spam and excessive outgoing e-mails\u003C/h2>\n\n\u003Cp>Sending Spam through the StartMail Service is prohibited. In order to block Spam\nand to mitigate the risk that StartMail could be blacklisted by other e-mail\nproviders or their spam filters, which may cause severe adverse effects for all\nUsers of the StartMail Service, we limit the number of messages that can be sent\nduring a given time period. Consequently, if you send too many messages in a\nshort time, your outgoing messages may be blocked, even if your messages are not\nunsolicited and do not strictly qualify as Spam, as defined in the definitions\nsection below. When your outgoing messages are blocked for this reason, you will\nbe informed via a warning message.\u003C/p>\n\n\u003Cp>If we find that you are sending excessive amounts of messages often or\nregularly, compromising the ability of other Users to enjoy the StartMail\nService fully, we may suspend or terminate your Account, after we have issued at\nleast one warning to you.\u003C/p>\n\n\u003Cp>In order to safeguard the effectiveness of our measures against Spam and\nexcessive outgoing messages, we cannot provide full details of the measures we\nemploy, nor the exact limitations caused by these measures.\u003C/p>\n\n\u003Cp>Our measures against Spam and excessive outgoing messages should not affect\nnormal, average use of the StartMail Service. If you experience that your\nlegitimate (and not excessive) e-mails are not being sent or received properly,\nor that our anti-Spam measures may otherwise impair your legitimate use of the\nStartMail Service, please inform us as soon as possible through\n\u003Ca href=\"mailto:spam@startmail.com\">spam@startmail.com\u003C/a>. Please include as much technical information as possible\nindicating that the problems are due to our systems and are not caused by other\nlinks in the Internet communication chain which are beyond our control.\u003C/p>\n\n\u003Ch2>Compliance with legitimate requests by authorities\u003C/h2>\n\n\u003Cp>While we respect and try to protect your privacy to the best of our abilities,\nyour use of StartMail does not place you above the law. But neither do we place\nauthorities above the law. If we receive a request by Dutch judicial authorities\nto hand over information about one of our Users, we will have our lawyers check\nthe validity of the request and determine whether we are obliged to comply. We\nwill NOT comply with such requests unless we are convinced that the request is\nlegally valid and we believe it is undeniably our legal obligation to comply.\u003C/p>\n\n\u003Cp>We will not comply with requests from any authorities other than Dutch\nauthorities. If we receive a request from any foreign government, we will refuse\nto comply and will instead refer the requestor to place a formal request to the\nDutch authorities for mutual assistance.\u003C/p>\n\n\u003Cp>StartMail will never cooperate with any voluntary surveillance programs. Under\nthe strong current laws that protect the right to privacy in Europe, European\ngovernments cannot legally force service providers like StartMail to implement a\nblanket spying program on their users. Should that ever change, we will use all\nmethods at our disposal to resist.\u003C/p>\n\n\u003Ch2>Requests by private third parties\u003C/h2>\n\n\u003Cp>We will not comply with any requests from private third parties to provide\ninformation about our Users, unless we would receive a valid Dutch court order\nto such effect.\u003C/p>\n\n\u003Ch2>Support Center\u003C/h2>\n\n\u003Cp>The User can report disruptions and ask questions in the manner indicated by\nStartMail on the Website. StartMail will try to respond to such questions\nproperly and within a reasonable term, but cannot offer any guarantees in this\nrespect.\u003C/p>\n\n\u003Cp>Information regarding the use of the StartMail Service is provided to the User\nthrough the Support Center on the Website. The User is expected to read the\ninformation available there first, before submitting a question via\n\u003Ca href=\"mailto:support@startmail.com\">support@startmail.com\u003C/a>.\u003C/p>\n\n\u003Ch2>Updates\u003C/h2>\n\n\u003Cp>StartMail may modify the software of the StartMail Service as the occasion\narises in order to improve functionality and rectify errors. These changes may\nbe made without prior notice to you. Because the StartMail Service is offered to\nmultiple Users, it is not possible to omit a modification for a single\nUser. StartMail is not liable for compensation for any loss incurred as a result\nof the modification of the StartMail Service.\u003C/p>\n\n\u003Ch2>Availability and maintenance\u003C/h2>\n\n\u003Cp>We strive to provide uninterrupted and optimal availability of the StartMail\nService, but we do not offer any guarantees thereof, unless otherwise agreed by\nmeans of a Service Level Agreement concluded to that effect. StartMail reserves\nthe right to deactivate the StartMail Service temporarily for maintenance,\nmodification or improvement of the Service and the web servers of\nStartMail. StartMail will attempt to ensure that temporary deactivation of\nStartMail Service causes as little disruption as possible to Users.\u003C/p>\n\n\u003Cp>Under no circumstances will StartMail be liable to pay any compensation for any\ndamage sustained by the User due to the Service being deactivated for\nmaintenance purposes.\u003C/p>\n\n\u003Ch2>Backup\u003C/h2>\n\n\u003Cp>Multiple Backups are made daily of all Accounts, with a maximum interval of one\nhour between each backup. StartMail determines the execution time of the\nbackups. Data stored in backup form is retained for no longer than three days.\u003C/p>\n\n\u003Cp>In addition to relying on the emergency backup system of our infrastructure, you\nmay choose to also store your own local copies of your data, or not. If your\nAccount is terminated in accordance with these Terms of Service, we may\npermanently delete your data from our servers. We have no obligation to return\ndata to you after the Agreement between you and us is terminated.\u003C/p>\n\n\u003Ch2>Data extraction\u003C/h2>\n\n\u003Cp>Users are enabled to retrieve and store their full inbox, or parts thereof,\nlocally via IMAP.\u003C/p>\n\n\u003Ch2>Security\u003C/h2>\n\n\u003Cp>StartMail uses extended validation SSL certificates to securely transmit data\nand communications on the Website and via the StartMail Service. Please read\nour security white papers for more detailed information about our security\nmeasures.\u003C/p>\n\n\u003Ch2>Personal details\u003C/h2>\n\n\u003Cp>StartMail processes personal details solely in accordance with the Privacy\nPolicy, which can be found at: \u003Ca href=\"/privacy/\">https://www.startmail.com/privacy/\u003C/a>.\u003C/p>\n\n\u003Ch2>Prices and payment\u003C/h2>\n\n\u003Cp>To use the StartMail Service, a User must first pay StartMail the applicable fee\nindicated in the Agreement. Paying the fee up front gives the User the right to\naccess and use the StartMail Service for the time period indicated in the\nAgreement. For example: the Agreement states that the User shall pay a certain\namount per year. The User must pay this amount up front and shall then receive\naccess to the StartMail Service for one (1) year, starting from the moment on\nwhich StartMail receives payment. StartMail may from time to time apply certain\npromotional offers giving you the option to create an Account and use the\nStartMail Service for free for a certain period, or charge your payment method\nonly after you have had the option to try the StartMail Service for a certain\nperiod with the option to cancel your subscription for any or no reason. The\nspecific details and terms and conditions of such promotional offers are\nspecified during the sign-up process.\u003C/p>\n\n\u003Cp>All prices stated by StartMail are inclusive of applicable turnover tax (VAT)\nand other levies imposed by the government.\u003C/p>\n\n\u003Ch2>EXCLUSION OF WARRANTIES\u003C/h2>\n\n\u003Cp>StartMail PROVIDES THE StartMail Service AND THE WEBSITE "AS IS" AND "AS\nAVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND. TO THE EXTENT PERMITTED BY\nAPPLICABLE LAW, StartMail DISCLAIMS ANY IMPLIED WARRANTIES OR\nREPRESENTATIONS. StartMail EXPRESSLY DOES NOT REPRESENT OR WARRANT THAT THE\nStartMail Service WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE, UNINTERRUPTED,\nSECURE OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.\u003C/p>\n\n\u003Ch2>LIMITATION OF LIABILITY\u003C/h2>\n\n\u003Cp>UNDER NO CIRCUMSTANCES IS StartMail LIABLE FOR ANY INDIRECT DAMAGE SUSTAINED BY\nTHE USER OR THIRD PARTIES, INCLUDING CONSEQUENTIAL DAMAGE, LOSS OF TURNOVER, AND\nIMMATERIAL DAMAGE.\u003C/p>\n\n\u003Cp>THE LIABILITY OF StartMail AGAINST THE USER, ON WHATEVER GROUND (INCLUDING\nFAILURE TO COMPLY WITH A WARRANTY OBLIGATION), SHALL BE LIMITED TO THE\nSUBSCRIPTION FEES PAID BY THE USER, UP TO A MAXIMUM OF € 500.00 (FIVE HUNDRED\nEURO), EXCLUDING VAT, WHEREBY A SERIES OF CONNECTED EVENTS SHALL BE CONSIDERED A\nSINGLE EVENT.\u003C/p>\n\n\u003Cp>THE USER INDEMNIFIES StartMail AGAINST ANY AND ALL CLAIMS BROUGHT BY\nTHIRD PARTIES IN RESPECT OF COMPENSATION OF DAMAGE, COSTS OR INTEREST\nIN CONNECTION WITH THE USER'S USE OF THE StartMail Service.\u003C/p>\n\n\u003Cp>THE PRECEDING SUBSECTIONS OF THIS ARTICLE DO NOT APPLY IF AND INSOFAR AS AN\nINTENTIONAL ACT OR OMISSION OR WILFUL RECKLESSNESS ON THE PART OF THE MANAGEMENT\nOF StartMail CAUSED THE DAMAGE IN QUESTION.\u003C/p>\n\n\u003Ch2>Force Majeure\u003C/h2>\n\n\u003Cp>StartMail will not be obliged to comply with any obligation towards the User if\nit is prevented from doing so as a result of a circumstance over which it has no\ncontrol.\u003C/p>\n\n\u003Cp>In the event of such a situation involving Force Majeure -- which in any event\nincludes disruptions in the telecommunications infrastructure, Internet,\ndomestic disturbances, mobilization, war, traffic congestion, strikes, lockouts,\nimport and export restrictions, business interruptions, supply delays, fire,\nflood and breaches by suppliers on whom StartMail is dependent in the\nperformance of an Agreement -- the performance of the Agreement may be suspended\nwithout that leading to any obligation to pay compensation.\u003C/p>\n\n\u003Cp>If a situation involving Force Majeure prevents compliance for longer than two\nmonths, either Party will be entitled to terminate the Agreement immediately\nwithout that giving rise to any obligation to pay compensation.\u003C/p>\n\n\u003Ch2>Intellectual property rights\u003C/h2>\n\n\u003Cp>StartMail (or its licensors) retain all legal right, title and interest in and\nto the StartMail Service and the StartMail Website. This includes any\nintellectual property right subsisting in the StartMail Service, the Website and\nany part thereof. You acknowledge these rights and agree to respect them at all\ntimes. The e-mail messages which Users may send using the StartMail Service\n(including header, body text and attachments) are not the property of StartMail,\nnor does StartMail claim any right thereto, or accept any responsibility towards\nthe content thereof.\u003C/p>\n\n\u003Cp>The Agreement grants the User a personal, worldwide, non-assignable and\nnon-exclusive right to use the StartMail Service. Unless otherwise agreed by\nmeans of a separate agreement, "use" shall not mean to reproduce, duplicate,\ncopy, sell, trade or resell.\u003C/p>\n\n\u003Ch2>Amendments to the Terms of Service\u003C/h2>\n\n\u003Cp>StartMail reserves the right to make minor amendments to the Terms of Service at\nany time without notice to the Users.\u003C/p>\n\n\u003Cp>Amendments to the Terms of Service shall also apply in respect of Agreements\nthat have already been concluded.\u003C/p>\n\n\u003Cp>The most current version of the Terms of Service can be reviewed on the\n'Sign-up' page.\u003C/p>\n\n\u003Cp>Users will be notified of any Amendments to the Terms of Service which StartMail\nconsiders of material impact on the Users' rights under the Agreement, at least\n30 days before the amendment will take effect.\u003C/p>\n\n\u003Cp>Users have the right to refuse material amendments to the Terms of Service. Such\nrefusal must be communicated to StartMail, by e-mail through\n\u003Ca href=\"mailto:support@startmail.com\">support@startmail.com\u003C/a>, before the date on which the amendments take effect. In\nsuch case, the Agreement will remain in effect unamended until terminated.\u003C/p>\n\n\u003Ch2>Termination by the User\u003C/h2>\n\n\u003Cp>Any User can terminate the Agreement by clicking a button or link within the\nStartMail Website containing "Terminate Account" or words of a similar nature\nand meaning. A User may terminate the Agreement in this way at any time and\nwithout stating any reasons or grounds for doing so.\u003C/p>\n\n\u003Cp>Terminating the Agreement does not constitute or create the right to ask for\nrepayment or refund of (all or part of) the subscription fee for the period\nduring which the Agreement would otherwise have remained valid.\u003C/p>\n\n\u003Cp>When an Agreement is terminated by a User, all data contained in the Account,\nincluding all e-mails, is immediately deleted permanently. Only the backup will\nremain for the maximum retention period of three days, as described in the\nBackup section above. The User has no right to obtain or gain access to data\nstored in this temporary backup after termination.\u003C/p>\n\n\u003Ch2>Expiration and renewal\u003C/h2>\n\n\u003Cp>When the payment term of your Account expires, a quarantine period of six (6)\nmonths starts. The first thirty (30) days of this period will be considered a\ngrace period and certain restrictions may apply.\u003C/p>\n\n\u003Cp>After this grace period of thirty (30) days, the User can no longer make use of\nthe product and the Account will be put in quarantine state. If the User pays\nthe applicable fee after the grace period but within six (6) months after\nexpiration, the Account will be reinstated, and a new payment term will start\nfrom the moment of payment.\u003C/p>\n\n\u003Cp>Before expiration of the Account, StartMail will provide multiple messages by\ne-mail (including the Recovery E-mail Address, if provided by the User), in\norder to remind the User of the upcoming expiration of the Account, and of the\noption of providing payment to maintain the use of the Account.\u003C/p>\n\n\u003Cp>If the User does not pay the required fee within six (6) months after the start\nof the quarantine period, the Agreement will be deemed fully terminated and the\nAccount will be deleted.\u003C/p>\n\n\u003Ch2>Consequences of termination\u003C/h2>\n\n\u003Cp>When an Agreement is fully terminated, all data contained in the Account,\nincluding all e-mails, is immediately deleted permanently. Only the backup will\nremain for the maximum retention period of three days, as described in the\nBackup section above. StartMail has no obligation to restore an Account from\nsuch backups on request of the User once the Account has been terminated.\u003C/p>\n\n\u003Ch2>Final provisions\u003C/h2>\n\n\u003Cp>The Agreement shall be governed by Dutch law, without regard to any conflict of\nlaw provisions contained in Dutch law.\u003C/p>\n\n\u003Cp>The court of the Hague, the Netherlands, shall have exclusive jurisdiction to\nsettle disputes relating to the Agreement which cannot be settled amicably,\nexcept if Dutch imperative law should provide otherwise.\u003C/p>\n\n\u003Cp>In the event that StartMail requires urgent legal measures or relief against a\nUser and the court chosen above cannot provide this, StartMail may submit an\napplication to any other court in any other jurisdiction.\u003C/p>\n\n\u003Cp>Changes in management or legal form will not affect the Agreement.\u003C/p>\n\n\u003Cp>Partial nullity: in the event that one or more of the provisions of this\nAgreement and/or the Terms of Service should be nullified, the remaining\nprovisions of this Agreement and/or the Terms of Service shall remain in full\nforce. In this case, the Parties shall agree on (a) new provision(s) to replace\nthe nullified provisions, having regard to the purpose and purport of the\noriginal Agreement and/or Terms of Service as far as possible.\u003C/p>\n\n\u003Cp>If StartMail does not exercise or enforce a legal right or remedy which is\navailable to StartMail under the Agreement and applicable law, this will not\nconstitute a formal waiver and StartMail will still be entitled to such rights\nor remedies.\u003C/p>\n\n\u003Ch2>Definitions (2)\u003C/h2>\n\n\u003Cp>\u003Cstrong>Account\u003C/strong>: the User's personal email boxes, contacts and settings associated\nwith one StartMail e-mail address.\u003C/p>\n\n\u003Cp>\u003Cstrong>Agreement\u003C/strong>: any agreement that is concluded between StartMail and the User\nthat is subject to these Terms of Service.\u003C/p>\n\n\u003Cp>\u003Cstrong>Login Details\u003C/strong>: the details, such as e-mail address and password, which must\nbe entered to gain access to the StartMail Service.\u003C/p>\n\n\u003Cp>\u003Cstrong>Party\u003C/strong>: a party to the Agreement, either StartMail or the User.\u003C/p>\n\n\u003Cp>\u003Cstrong>Privacy Policy\u003C/strong>: the document describing StartMail's privacy practices, which\ncan be found\nat: \u003Ca href=\"/privacy/\">https://www.startmail.com/privacy/\u003C/a>.\u003C/p>\n\n\u003Cp>\u003Cstrong>Recovery Code\u003C/strong>: a code securely generated by StartMail which can be used by\nthe User to access an Account when the password for the Account has been lost.\u003C/p>\n\n\u003Cp>\u003Cstrong>Recovery E-mail Address\u003C/strong>: an alternative e-mail address meant to receive the\nLogin Details in the event of loss, and to provide an alternative means for\nStartMail to communicate with the User in the event the Account is not usable or\naccessible.\u003C/p>\n\n\u003Cp>\u003Cstrong>Settings\u003C/strong>: the menu accessible in the StartMail Service, providing certain\noptions to Users.\u003C/p>\n\n\u003Cp>\u003Cstrong>Spam\u003C/strong>: unsolicited e-mail messages for commercial or charitable purposes for\nwhich the receiver has not "opted in," meaning the receiver has not given his\nprior (informed) consent to receiving such messages from the sender. "Spam" in\nthese Terms of Service should be understood in context of the legal provisions\nwithin the applicable jurisdiction(s) regarding unsolicited electronic messages.\u003C/p>\n\n\u003Cp>\u003Cstrong>StartMail\u003C/strong>: StartMail B.V., having its registered office at Boulevard 11,\n3707BK in Zeist and registered at the Dutch Chamber of Commerce under\nno. 341111280. StartMail is also what "we", "us" and "our" refer to in this\ndocument.\u003C/p>\n\n\u003Cp>\u003Cstrong>StartMail Service\u003C/strong>: the service of making the StartMail e-mail application\navailable to the Users via the Internet.\u003C/p>\n\n\u003Cp>\u003Cstrong>Support Center\u003C/strong>: the section of the Website that provides detailed\ninformation about the StartMail Service.\u003C/p>\n\n\u003Cp>\u003Cstrong>Terms of Service\u003C/strong>: the terms and conditions contained in this document.\u003C/p>\n\n\u003Cp>\u003Cstrong>User\u003C/strong>: a natural person or legal entity that concludes an Agreement with\nStartMail to use the StartMail Service.
