After years of deliberation, the European Parliament published the\u003Cspan> \u003C/span>\u003Ca href=\"https://gdpr-info.eu/\" rel=\"noopener noreferrer\">General Data Protection Regulation (GDPR)\u003C/a>\u003Cspan> \u003C/span>to replace outdated privacy-related laws from 1995. Two years later, GDPR became law.\u003C/p>\n\u003Ch3>What is GDPR?\u003C/h3>\n\u003Cp>GDPR is a set of laws that outlines the digital rights of EU citizens relating to their personal information. In a nutshell, the GDPR’s primary goals are to:\u003C/p>\n\u003Cul>\n  \u003Cli>Give consumers more control over their private data\u003C/li>\n  \u003Cli>Allow people to understand how companies use consumer data\u003C/li>\n  \u003Cli>Ensure companies protect such data\u003C/li>\n  \u003Cli>Set standardized laws across all countries in the EU\u003C/li>\n\u003C/ul>\n\u003Cp>Companies who break the GDPR’s laws can\u003Cspan> \u003C/span>\u003Ca href=\"https://www.csoonline.com/article/562107/general-data-protection-regulation-gdpr-requirements-deadlines-and-facts.html\" rel=\"noopener noreferrer\">face fines of up to €10 million\u003C/a>, or 4% of the company’s annual global turnover, whichever is higher. This law means that big revenue companies need to fork over large sums if caught breaking the rules.\u003C/p>\n\u003Cp>So far,\u003Cspan> \u003C/span>\u003Ca href=\"https://www.zdnet.com/article/gdpr-google-hit-with-eur50-million-fine-by-french-data-protection-watchdog/\" rel=\"noopener noreferrer\">GDPR issued its most significant fine\u003C/a>\u003Cspan> \u003C/span>of €50 million after the French data protection watchdog CNIL accused Google of processing people’s data for advertising.\u003C/p>\n\u003Ch3>What is the reach of GDPR legislation? \u003C/h3>\n\u003Cp>GDPR applies to every business within the EU and every business outside of the EU that has EU citizens as customers. This means that companies with global reaches – such as social media, streaming platforms, e-commerce, and most internet-related firms – all must\u003Cspan> \u003C/span>\u003Ca href=\"https://www.zdnet.com/article/gdpr-an-executive-guide-to-what-you-need-to-know/\" rel=\"noopener noreferrer\">comply with GDPR laws\u003C/a>.\u003C/p>\n\u003Cp>The GDPR specifies several\u003Cspan> \u003C/span>\u003Ca href=\"https://www.csoonline.com/article/562107/general-data-protection-regulation-gdpr-requirements-deadlines-and-facts.html\" rel=\"noopener noreferrer\">company roles\u003C/a>\u003Cspan> \u003C/span>that are responsible for handling data:\u003C/p>\n\u003Cul>\n  \u003Cli>\u003Cstrong>Data controllers\u003C/strong>\u003Cspan> \u003C/span>specify how and why data is processed. Duties include notifying authorities of data breaches, ensuring third parties comply with GDPR, and providing personal data records when consumers ask for them.\u003C/li>\n  \u003Cli>\u003Cstrong>Data processors\u003Cspan> \u003C/span>\u003C/strong>are, as their name would suggest, the ones responsible for processing the data. They answer to controllers and notify the controllers if they spot a data breach. GDPR holds data processors to high standards, and the blame ultimately falls upon them for breaches and rule-breaking.\u003C/li>\n  \u003Cli>\u003Cstrong>Data protection officers\u003Cspan> \u003C/span>\u003C/strong>(DPO) are the ones responsible for overseeing GDPR compliance and security measures. Companies must appoint a DPO if they handle large amounts of data, are a public authority, or process data in a way that’s “particularly far-reaching for the rights of the data subjects.”\u003C/li>\n\u003C/ul>\n\u003Cp>The GDPR does allow\u003Cspan> \u003C/span>\u003Ca href=\"https://www.compliancejunction.com/who-is-exempt-from-gdpr-requirements/\" rel=\"noopener noreferrer\">some exemptions\u003C/a>, such as:\u003C/p>\n\u003Cul>\n  \u003Cli>Processed data related to household and personal matters\u003C/li>\n  \u003Cli>Government and legal bodies for data usage to fight or prevent crime\u003C/li>\n  \u003Cli>Activities that fall outside EU laws\u003C/li>\n\u003C/ul>\n\u003Ch3>What data does GDPR protect?\u003C/h3>\n\u003Cp>The GDPR defines\u003Cspan> \u003C/span>\u003Ca href=\"https://gdpr-info.eu/art-4-gdpr/\" rel=\"noopener noreferrer\">personal data\u003C/a>\u003Cspan> \u003C/span>as “any information relating to an identified or identifiable natural person.”\u003C/p>\n\u003Cp>This definition includes all the obvious choices – names, addresses, phone numbers, social security numbers, and more – but also contains IP addresses, genetic data, biometric data, political opinions, and social media posts. It doesn’t matter if the data is public and only makes indirect references – GDPR still applies.\u003C/p>\n\u003Cp>With this in mind, GDPR mandates that companies adhere to “privacy by design” – all technologies and systems must have built-in data protection. For example, GDPR encourages pseudonymization – this replaces private data by artificial identifiers. With pseudonymization, a person’s name translates to a random code of characters. Anyone who steals such data won’t be able to decipher such cryptic codes.\u003C/p>\n\u003Cp>Companies must also report data breaches to the relevant authorities or face hefty fines. Consumers affected by such violations can request compensation from the company. \u003C/p>\n\u003Ch3>What individual rights does GDPR grant?\u003C/h3>\n\u003Cp>GDPR empowers users by ensuring companies do their best to protect sensitive data. A few of these rights include the right to access, the right to be informed, and the right to be forgotten.\u003C/p>\n\u003Ch4>The right to access\u003C/h4>\n\u003Cp>As mentioned earlier, consumers can request an electronic copy of personal data from a company’s data controller. Companies must provide such data within one month. Those who ignore a user’s access request may face fines.\u003C/p>\n\u003Ch4>The right to be informed\u003C/h4>\n\u003Cp>“\u003Ca href=\"https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/individual-rights/individual-rights/right-to-be-informed/\" rel=\"noopener noreferrer\">The right to be informed\u003C/a>” means that consumers have a right to know:\u003C/p>\n\u003Cul>\n  \u003Cli>How companies use their data\u003C/li>\n  \u003Cli>How long companies will retain such data\u003C/li>\n  \u003Cli>Whom the companies will share data with\u003C/li>\n\u003C/ul>\n\u003Cp>Companies must provide information in a way that clear, accessible, and easy-to-understand.\u003C/p>\n\u003Ch4>The right to be forgotten\u003C/h4>\n\u003Cp>One of GDPR’s significant rules is the consumer’s “\u003Ca href=\"https://gdpr.eu/right-to-be-forgotten/\" rel=\"noopener noreferrer\">right to be forgotten\u003C/a>.” This gives people the right to request that organizations delete a user’s data. Users can exercise this right under a few different circumstances, including:\u003C/p>\n\u003Cul>\n  \u003Cli>The data is now unnecessary for the company\u003C/li>\n  \u003Cli>The organization needs ongoing consent to use the data\u003C/li>\n  \u003Cli>The organization uses the data for marketing practices without the user’s consent\u003C/li>\n  \u003Cli>The company processed the data illegally\u003C/li>\n  \u003Cli>The company must delete the data to comply with the law\u003C/li>\n\u003C/ul>\n\u003Cp>The organization can sometimes override the user’s request, such as the use of data for public interest or legal reasons.\u003C/p>\n\u003Ch3>How do companies remain GDPR compliant?\u003C/h3>\n\u003Cp>The GDPR’s rules are incredibly comprehensive, and some companies might have trouble maintaining compliance. As a general guideline, your company should:\u003C/p>\n\u003Cul>\n  \u003Cli>\u003Cstrong>Appoint a DPO.\u003Cspan> \u003C/span>\u003C/strong>The DPO doesn’t have to be a unique position to appoint someone already within the company. You may consider hiring an outside DPO if they’re well-versed in the GDPR laws.\u003C/li>\n  \u003Cli>\u003Cstrong>Create a plan to protect data.\u003Cspan> \u003C/span>\u003C/strong>Most companies already have an idea, but it’s essential to have a set of ground rules. \u003C/li>\n  \u003Cli>\u003Cstrong>Periodically review security measures.\u003Cspan> \u003C/span>\u003C/strong>Make sure there are no gaps in your security plan. Regularly test for areas that hackers can exploit.\u003C/li>\n  \u003Cli>\u003Cstrong>Employ a “zero trust” policy.\u003Cspan> \u003C/span>\u003C/strong>Nobody inside or outside the organization should be trusted with data by default. This policy means that nobody has access to anything without proper verification. \u003C/li>\n  \u003Cli>\u003Cstrong>Only give employees access to the information they need.\u003Cspan> \u003C/span>\u003C/strong>One of the best ways to prevent data breaches is to ensure that employees don’t have access to unnecessary files. According to a\u003Cspan> \u003C/span>\u003Ca href=\"https://www.varonis.com/blog/cybersecurity-statistics\" rel=\"noopener noreferrer\">Varonis report\u003C/a>, 53% of companies had over 1,000 private files that every employee could access. \u003C/li>\n\u003C/ul>\n\u003Cp>You may remember back in 2018, when GDPR first became law.
